Terms & Conditions

These Terms and Conditions govern your access to and use of the Teacher Superstore website and any purchases you make from us, online or in store. Please read them carefully. By using our website or buying from us, you agree to these terms.

This website and our stores are operated by Teacher Superstore (ABN 99 142 863 134), with our principal place of business in Osborne Park, Western Australia. We have retail stores in Osborne Park (Perth) and Ringwood (Melbourne). In these terms, “we”, “us” and “our” mean Teacher Superstore, and “you” and “your” mean any person who uses our website or buys from us. These terms should be read together with our Privacy Policy.

Your consumer rights

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. For a major failure with a product, you are entitled to a replacement or refund, and to compensation for any other reasonably foreseeable loss or damage. You are also entitled to have a product repaired or replaced if it fails to be of acceptable quality and the failure does not amount to a major failure. Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded.

Using our website

To buy from us, you must be at least 18 years of age and able to enter into a binding contract. When using our website, you must not attempt to gain unauthorised access to it or to connected systems, interfere with its normal operation, introduce harmful code, use automated tools to copy content without our permission, or use the website for any unlawful purpose.

If you create an account, you are responsible for keeping your login details secure and for activity that occurs under your account. Please contact us promptly if you believe your account has been used without your authorisation.

Website content and availability

We provide our website on an “as is” and “as available” basis. Product descriptions, images and prices are provided as a guide and may be updated or corrected at any time. While we take care to keep our content accurate and current, we do not warrant that it is always complete, accurate or free of errors, and product packaging or details may occasionally differ from what is shown. Where a particular feature is important to you, please confirm it with us or the manufacturer before purchasing. We may change, suspend or withdraw all or part of the website at any time.

Products and prices

All prices are shown in Australian dollars and include GST where it applies. Information shown on our website and in our stores is an invitation to treat, not an offer. If you buy from outside Australia, you are responsible for any overseas taxes, duties or import fees. We may change prices and product availability at any time before we accept your order.

Your order

When you place an order, you are making an offer to buy the product. We are not obliged to accept any order, and all orders are subject to availability. We may accept or decline an order, or part of an order, and may cancel or vary an order before it is fulfilled, for example if a product is unavailable or a price or description error has occurred. A binding contract is formed only when we send you an order confirmation. If we cannot fulfil an order you have paid for and cannot offer a suitable alternative, we will refund you.

Payment

You can pay using the methods shown at checkout, which currently include Visa, Mastercard and American Express, PayPal, Afterpay, Zip, and Apple Pay and Google Pay. In our stores you can also pay by cash or EFTPOS. Registered Australian educational institutions may apply to pay by official school purchase order on 30-day payment terms, as described on our School Orders and Purchase Orders page and subject to the “School and account orders” section below. Payment for all other orders is due in full when you place the order.

Delivery and risk

We deliver within Australia and internationally. Delivery charges and estimated timeframes are shown at checkout and on our Shipping and Delivery page. Delivery dates and times are estimates only and may change. You are responsible for providing a correct delivery address and, where you ask us to leave a parcel without a signature, a safe place to leave it. Risk in a product passes to you on delivery. To the extent permitted by law and subject to the Australian Consumer Law, we are not liable for loss or damage caused by an incorrect address you have provided or by your failure to follow a carrier's collection instructions.

Returns, refunds and cancellations

If a product is faulty, damaged or not as described, you are entitled to a remedy under the Australian Consumer Law, and we will repair, replace or refund it. Please contact us with your order number and details of the problem.

Under the Australian Consumer Law, we are not required to provide a refund or exchange for change of mind. We may, at our discretion, approve a change-of-mind return if you contact us within 14 days of purchase. Approved change-of-mind returns are issued as store credit, a 20% restocking fee applies, return freight is at your cost, and items must be unused and in original, resaleable condition, with proof of purchase. Full details, including exclusions, are on our Returns and Exchanges page. We may decline a return where a product has been damaged after delivery through no fault of ours.

School and account orders

If you buy from us on account or credit terms, such as a school or organisation approved for purchase-order billing, the following also applies:

  • Payment is due within 30 days of the invoice date, unless we agree otherwise in writing.
  • If an account is not paid by the due date, we may charge interest at 10% per annum, calculated daily, on overdue amounts; suspend or cancel unfulfilled orders; withhold any discount or rebate; and take reasonable steps to recover the amount owing, including reasonable recovery costs.
  • Until a product is paid for in full, it remains our property. While title remains with us, you agree that we may, on reasonable notice and at a reasonable time, enter premises where the product is kept to inspect or recover it.
  • You may not set off or withhold any amount you owe us on account, except as required by law.

Intellectual property

All content on our website, including text, graphics, images, logos and trademarks, is owned by or licensed to Teacher Superstore and is protected by Australian and international intellectual property laws. You may view and print content for your personal, non-commercial use. You must not otherwise copy, reproduce, modify, distribute or commercially use any content, or use our trademarks, without our prior written permission.

Our liability

To the extent permitted by law, and subject to your rights under the Australian Consumer Law, we are not liable for any loss or damage arising from your use of, or inability to use, our website, or from reliance on its content. Where our liability for a failure to meet a consumer guarantee can be limited (and the guarantee is not one that cannot be limited by law), our liability is limited, at our option, to replacing or repairing the product, supplying an equivalent product, or paying the cost of doing so.

Indemnity

You agree to compensate us for loss we reasonably incur arising from your breach of these terms or your misuse of our website, except to the extent that loss is caused or contributed to by us.

Links to other websites

Our website may contain links to other websites. We provide these for your convenience and are not responsible for the content, products or privacy practices of those websites. Accessing any linked website is at your own risk.

Privacy

We handle your personal information in accordance with our Privacy Policy.

Changes to these terms

We may update these terms from time to time. The current version posted on this page applies to your use of our website and any new orders. If you do not agree with a change, please stop using the website.

Suspension and termination

We may suspend or end your access to our website where it is reasonable to do so, for example if you breach these terms, if required by law, or for technical or security reasons.

Assignment

We may transfer our rights and obligations under these terms to a related entity or as part of a sale of our business. Where we do, your rights under these terms and the Australian Consumer Law are not reduced.

Governing law

These terms are governed by the laws of Western Australia, and you and we submit to the non-exclusive jurisdiction of the courts of that state.

General

These terms and our Privacy Policy make up the entire agreement between you and us regarding your use of our website and your purchases. If we do not enforce a right, that is not a waiver of it. If any part of these terms is found to be invalid, the rest continues to apply. Notices to you will be sent to the email address you provide; notices to us should be sent to the contact details on our Contact Us page.
